1. Scope

(1) Orders placed through this shop are subject exclusively to the following General Terms and Conditions in the version valid at the time of the order. These take precedence over any conflicting General Terms and Conditions.

2. Conclusion of contract

The offers in our online shop are non-binding and subject to change. Not all products are available from stock; special requests and custom orders must be clarified individually regarding material availability and craftsmanship.

When you place an order online, you submit a binding offer to conclude a contract, to which you are bound for 7 days after the order is sent. A valid purchase contract is only concluded upon our confirmation of your offer. An automatically sent confirmation of receipt of your order does not constitute acceptance of the contract. If you do not receive confirmation of your offer within seven days, it will be deemed rejected.

3. Product information

(1) Our products are not toys and are generally intended for adults only. As a precautionary measure, we would like to point out that some urns contain small parts that could be swallowed and should therefore be kept out of reach of small children and animals.

(2) Unless expressly stated otherwise in the product description, all urns are suitable for indoor use only and for display only. Only urns expressly marked as such or removable parts of urns are suitable for transport.

(3) All urns must be placed in a stable and stable manner. If the customer fills the urn with the pet's ashes themselves, they must strictly follow the filling instructions provided and printed on the website. The shop operator is not liable for damage caused by improper filling of the ashes, unless they are at fault.

(4) Due to the manufacturing process, all urns have a filling hole of approximately 3 - 3.5 cm at the bottom of the urn. This is always standard for designer urns and is not a reason for complaint. Everything you need to easily rebury your loved one is included in the delivery.

(5) The images and photos shown on the website are considered examples. Minor deviations in shape and color are not considered defects.

4. Prices and payment terms

(1) All prices include VAT, shipping within Germany is 7.90€ .
Shipping to countries outside Germany costs: 25,00 €

(2) The products will be delivered against advance payment, against PayPal payment, against bank debit, against credit card or on account.
If you choose prepayment or PayPal, you will receive the payment details necessary for the transfer along with our confirmation email and the conclusion of the purchase contract. All payments must be made within seven days of receiving the confirmation email.
If you choose to purchase on account, by direct debit or by credit card, an invoice will be sent at the same time as the goods. This invoice serves as confirmation of the order, contains all necessary payment details and is created by our contractual partner Secupay AG.
To avoid delays in payments, please always include your order number.

(3) If the buyer exercises his statutory right of withdrawal, he shall bear the costs of returning the product to the shop operator's address stated in section 1 of these terms and conditions.

5. Delivery and performance time

(1) If the customer chooses advance payment or PayPal payment, the delivery time begins upon receipt of the purchase price in the shop operator's account, but not before the shop operator has confirmed the order to the customer and, for stock items without individual additional details, is based on the deadlines stated in the product description.

(2) The shop operator is free to start manufacturing the product or to initiate delivery before receipt of the purchase price.

(3) Delays in shipping due to unforeseeable delivery difficulties on the part of the manufacturer or the contracted craftsmen, transport difficulties on the part of the shipping companies (e.g., due to strikes), or force majeure are deemed not to be the fault of the shop operator. However, the shop operator undertakes to notify the buyer of such difficulties immediately.

(4) The products will be shipped by insured parcel through a transport company chosen by the shop operator, e.g. DHL.

(5) The buyer must immediately notify the deliverer of any transport damage; if necessary, he must reject a damaged shipment and immediately inform the shop operator, as otherwise the shop operator will not be able to enforce his claims against the transport company.

(6) If delivery to the buyer at the address specified in the order fails three times, the shop operator is free to withdraw from the contract and/or demand compensation.

6. Warranty

(1) Minor deviations of the product from the online description in terms of color, dimensions, or other quality and performance characteristics do not constitute warranty claims for the buyer. This applies in particular to the use of natural materials, which always exhibit irregularities in structure and color (e.g., wood, stone, etc.), as well as to the execution of prints and paintings/airbrushing. Portraits created are not guaranteed to be identical, but are free of defects if they are similar to the original within the scope of artistic freedom and the chosen execution technique.

(2) The shop operator has the choice between exchanging the goods and repairing them.

(3) In all other respects, the statutory provisions on warranty pursuant to the German Civil Code (BGB) shall apply.

7. Right of withdrawal

(1) If the buyer is a consumer, he or she is entitled to a statutory right of withdrawal for contracts concluded via distance selling, about which the shop operator will provide separate information. Express reference is made to the withdrawal policy, which is also available separately on the website.
You are responsible for the return shipping costs in the event of cancellation.

(2) According to Section 312 g of the German Civil Code (BGB), there is no right of withdrawal for contracts for the delivery of goods which are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, as well as for contracts for the delivery of goods if, after delivery, they have been inseparably mixed with other goods due to their nature.

(3) Urns/products with customization such as name, date, a desired motif, etc. are excluded from exchange/cancellation, as production begins immediately after receipt of the order.
Already used (filled) pet urns cannot be exchanged. The amount will only be refunded after a thorough inspection of the interior of the pet urn (please check before filling the urn) to see if everything corresponds to your expectations!
Please note that due to different screen resolutions there may be slight color variations in our products; this does not constitute grounds for complaint.

8. Applicable law and place of jurisdiction

(1) The contract language is German. The law of the Federal Republic of Germany applies to the processing of all orders placed via the online shop.

(2) If the buyer is subject to commercial transactions, the place of jurisdiction shall be Leipzig.

9. Platform for out-of-court online dispute resolution

10. Severability Clause

The invalidity of any provision of these General Terms and Conditions shall not affect the validity of the remaining provisions.
